different-concepts-to-challenge-or-oppose-unpopular-legal-systems-and-practices

The philosophy of law is a dynamic concept centered on the dynamism of legal concepts and the criteria for legal validity in different legal systems. As such, the philosophy of law can be applied in different concepts to challenge or oppose unpopular legal systems and practices. An ideal example of the philosophy of law in action is elaborately demonstrated in Martin Luther King Jr.’s Letter from Birmingham Jail. In his text, Luther Jr. sought to advocate and cultivate an active and nonviolent strategy to oppose racism. In this paper, I will analyze the letter from Birmingham jail and relate the case to the current state of racism in the United States of America in the modern world. The paper will aim at examining the possible correlation between the strategic proposal by King Jr. in the letter and the current legal system; and its applicability in opposing the institutionalization of racism in the country. It will evaluate the different anti-racist laws and how they have been implemented over the years.
